General Terms and Conditions of Business

The business relations between CUORE of Switzerland GmbH (hereinafter referred to as CUORE) and the customer shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.

1. General

These general terms and conditions apply to consumers as well as to entrepreneurs. Consumers within the meaning of these General Terms and Conditions are natural persons with whom business relations are entered into without any commercial or independent professional activity being attributable to them. Entrepreneurs within the meaning of these General Terms and Conditions are natural or legal persons or legal entities with whom business relations are entered into and who act in the exercise of their commercial or self-employed professional activities. Customers in the sense of these GTC are both consumers and entrepreneurs. Deviating terms and conditions of the customer shall not be accepted and shall not become an integral part of the contract.

2. Order, conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. When purchasing via the online order form, the goods intended for purchase are stored in the "shopping cart". The customer can call up the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time. After accessing the "Checkout" page and entering your personal data as well as the terms of payment and delivery, all order data will be displayed again. By clicking on the button "order now with costs" the customer places a binding order of the goods in the shopping cart. Confirmation of receipt of the order (order confirmation) follows immediately after the order has been sent and does not constitute acceptance of the contract. CUORE can accept the order by shipping the request. If CUORE is unable to accept the customer's order, the customer will be informed.

3. Pricing

The prices quoted include the statutory value added tax plus shipping costs. For deliveries within the European Union, the value added tax (VAT) will only be void if the customer provides a valid European value added tax identification number. For deliveries to end users, the following provisions - stipulated by German tax law - apply:
1. The order will either be invoiced with domestic German value added tax or
2. if the delivery thresholds of the EU member state are exceeded, the value added tax of the respective EU member state will be charged.

4. Shipping and handling

The shipping costs are not included in the price and depend on the value of the order, the condition of the goods (size, weight) and the respective delivery address.

5. Delivery, transfer of risk

Deliveries are only possible to delivery addresses within Europe. CUORE reserves the right to deliver to other countries. CUORE shall be entitled to make partial deliveries if these are reasonable for the customer. If CUORE carries out partial deliveries, these additional shipping costs will be borne by CUORE. The customer can return the goods within 14 days if the articles have not been used, worn or washed before. If the customer is an entrepreneur, the risk of accidental loss and/or accidental deterioration of the goods shall pass to the customer upon handover, in the case of a shipment purchase upon delivery of the goods to the freight forwarder, carrier or any other person designated to carry out the shipment. If the buyer is a consumer, the risk of accidental loss and/or accidental deterioration of the goods sold shall not pass to the buyer until the goods are handed over to the buyer, even in the case of a mail order purchase.

6. Right of withdrawal, right of return

You can cancel your contract within 14 days without stating reasons in text form (e. g. B. Letter, fax, e-mail) or - if the goods are handed over to you before the deadline - by returning the goods or by returning the goods received. The period begins after receipt of this instruction in text form (e. g. B. Letter, fax, e-mail), but not before receipt of the goods by the recipient (in case of recurring delivery of similar goods not before receipt of the first partial delivery) and also not before fulfilment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 Paragraphs 1 and 2 of the German Civil Code as well as our obligations in accordance with § 312e Paragraph 1 Sentence 1 of the German Civil Code in conjunction with Article 246 § 3 of the German Civil Code. 7. Cost of return shipment

The customer shall bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the item to be returned does not exceed an amount of EUR 40 or if, in the case of a higher price of the item, the consideration or a contractually agreed partial payment has not yet been paid at the time of revocation. Otherwise, the return shipment is free of charge for the customer within Germany.

8. Payment

The products ordered in the online shop are paid for using the following payment methodes:

  1. Credit card (Visacard / Mastercard)
  2. Bank transfer: the goods are not delivered until the payment has been credited to CUORE's account.
  3. PayPal

9. Personal data, data protection

All personal data will be treated confidentially. The data provided by the customer is only used for processing the order process and shipping and will be passed on to transport service providers commissioned by CUORE. The customer allows the processing of personal and factual data in order to process the ordering process and dispatch. In addition, address and order data are collected and processed for our own marketing purposes. Note: The customer can object to the use of his data for marketing purposes at any time by notifying CUORE or revoke his consent.

Web tracking, on this website, information about the surfing behaviour of website visitors is collected and stored for marketing purposes. This data is collected with the help of so-called. "Cookies"-text files stored on the customer's computer and allow us to analyze the surfing behavior. Under no circumstances can the data be used to personally identify the visitor of this website. The collected data will only be used to improve the offer. No other use or disclosure to third parties takes place. 10. Retention of title

The delivered goods remain the property of CUORE until full payment has been made.

11. Warranty coverage

The customer is obliged to check the consignment immediately upon receipt for completeness and integrity. If the package is damaged, the customer must also complain directly to the deliverer. If articles show material or manufacturing defects, the customer must complain about these recognizable defects immediately. Defects that are not immediately apparent shall be reported immediately after their discovery. The legal regulations apply. In the case of any type of defect, the customer shall first of all be entitled to free rectification of defects. CUORE has the right to repair or replace the item in whole or in part. If a defect is not remedied within a reasonable period of time, the customer shall be entitled to a claim for cancellation (reversal of the purchase) or a reduction (decrease of the purchase price). In the event of an error in the price announcement or product descriptions, CUORE is not bound by the incorrect information.


12. Place of jurisdiction

The contracting parties agree to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The language of the contract is German. The place of jurisdiction shall be in accordance with the statutory provisions. The place of performance for all business transactions is the company location. The place of performance for all services arising from the business relations existing with the supplier and the place of jurisdiction shall be the registered office of the supplier, insofar as the customer is not a consumer but a merchant or legal entity under public law.
